What if I have property at the sheriff's department?

If you believe you have property being held at the Sheboygan County Sheriff's Department, you may inquire by calling the Property Officer at (920) 459-3699, Monday through Friday, from 8 a.m. to 4 p.m.
A report or incidnet number will aid in researching any inquiry. Any property being held as evidence cannot be released until 90 days after the case is disposed of in court.
All property must be picked up in person at the sheriff's department.

How do I get my fingerprints taken?

The sheriff's department hours of operation for fingerprinting are as follows:

Monday through Friday
8 a.m. to 10 a.m.
2 p.m. to 4 p.m.

There is a $10.00 charge for fingerprinting. You must produce a photo identification, and supply your own fingerprint cards.

Tips On How To Help Make Your
Restraining Order Work For You

1.All temporary restraining orders granted by the Court Commissioner must be served on the respondent in order for it to be in effect.  The service is done by the Sheriff’s Department in the county were the respondent resides.  If it is a Harassment Injunction, you are responsible for any service fees imposed by the Sheriff’s Department (unless your fees have been waived by the Court Commissioner).  Before you come to apply for a restraining order, find out where the respondent lives and/or works.  It is your responsibility to provide the Sheriff’s Department with as much information as possible so they can serve the papers on the respondent quickly.

2.If you are granted a restraining order to keep another party away from you, DO NOT ATTEMPT TO MAKE CONTACT WITH THAT PERSON after the order is granted.  Enforcement of the injunction by the Police or Sheriff’s Department after voluntary contact has been made becomes extremely difficult and questions of credibility arise.

3.Basically, a restraining order is just a piece of paper, but it empowers law enforcement to more easily make an arrest.  Without a restraining order, law enforcement

Without a restraining order, law enforcement may only be able to give someone who is harassing you a warning.  With a restraining order in place, any violation of the conditions of your order can be investigated by law enforcement and an arrest can possibly be made.

.4.Be realistic about what a restraining order can offer.  If you are granted an injunction to keep another person away from you, it is your responsibility to report any violations to law enforcement.  Law enforcement will investigate the report and determine if an arrest is appropriate.

5.If you feel your injunction is no longer necessary, you will need to take the action of coming to the Courthouse to dismiss your order.  Do not have contact until you have done so, and have received the dismissal order in writing.

How much does it cost?
A Domestic Abuse Restraining Order is always free.  For a Harassment or Child Abuse Restraining Order, unless the person filing for the order can show that their safety is endangered by a threat or an actual physical assault, there is a filing fee of $155, and they must pay the Sheriff’s Department a fee to serve the paperwork on the respondent. The Sheriff’s Department service fee is $30 for the first attempt at service.  If necessary, up to two additional attempts at service will be made and these will be billed to the petitioner at $30 per attempt.  There is also a $5 service fee when incorrect location information is given. The filing fee and service fee are payable on the day the person fills out the paperwork for the order.

How long can I receive a restraining order for?
If the petition is granted for a Domestic Abuse Injunction, the maximum length of time would be 4 years.  If the petition is granted for a Harassment Injunction or a Child Abuse Injunction, the maximum length of time would be 2 years

Who can help me fill out the forms for a restraining order?
Obtaining a restraining order is a civil process and must be completed by the person petitioning for the order. Victim Witness will provide the forms required, but they cannot give legal advice.  Victim Witness provides assistance when there is an accompanying criminal case.  Safe Harbor is also available to assist in cases of domestic violence or sexual assault.  They can be reached at 452-7640.
